Vietnam Visa Overstay: Fines and How to Fix It
Staying in Vietnam past the date on your visa, exemption stamp or residence card is an administrative offence. The fine depends on how long you have overstayed, and it must be settled before you can exit or apply for a new status.
Fine levels

| 16 to under 30 days | 3,000,000 – 5,000,000 VND |
| 30 to under 60 days | 5,000,000 – 10,000,000 VND |
Longer overstays attract higher penalties and, in serious cases, deportation and an entry ban. Sponsoring companies can also be penalised for failing to manage the status of their foreign staff.
What to do
- Stop the clock — do not keep waiting. The fine rises by bracket.
- Prepare the file: passport, temporary residence declaration, and a sponsor if you intend to stay.
- Attend the Immigration Department to settle the penalty and receive the decision.
- Apply immediately for a new visa, an extension, or an exit permit if you are leaving.
Common causes we see
- Counting 45 visa-free days from the wrong date — the day of entry counts as day one.
- Assuming a residence card can be extended; it cannot, a new card must be issued.
- Filing an extension with the wrong form after 1 July 2026 and having it returned with no time left.
- Waiting for a work permit to be issued while the current visa expires.
