Foreigners who overstay their visa or temporary residence card by 16 days or more face fines from VND 5,000,000 to VND 40,000,000 depending on the length of the overstay (Article 21 of Decree 282/2025/NĐ-CP) and may be deported. In this situation you should not go straight to the airport: you need to visit the provincial Police Immigration Office or the Immigration Department to explain your case, pay the fine and receive instructions on the procedures for leaving Vietnam legally. Info Travel provides case-by-case consulting, prepares your documents and explanation letter, coordinates with your sponsor and supports you until you depart. Decree 282/2025/NĐ-CP took effect on 15 December 2025. In addition to the fine, depending on the nature and severity of the violation and any aggravating or mitigating circumstances, the violator may receive the additional penalty of deportation. A deported person may not re-enter Vietnam for a certain period under the Law on Entry and Exit of Foreigners (usually 3 years from the date the deportation decision takes effect).

Why you shouldn’t go straight to the airport after a long overstay
- The fine exceeds what can be handled quickly at the border gate, so the case is usually transferred to the immigration authority.
- You may be held for clarification, miss your flight and lose the cost of your ticket.
- The authorities need to check your residence history, place of stay, temporary residence registration and sponsor before allowing you to leave.
Buying a flight ticket does not resolve an overstay. Complete the procedures first, then fix your departure date.
How to resolve a long visa overstay and exit Vietnam
- Determine the exact number of days overstayed from your most recent visa, entry stamp or temporary residence card.
- Prepare your documents: original passport, expired visa/temporary residence card, details of your place of stay and temporary residence registration, a letter explaining the reason for the overstay with supporting evidence (medical records, lost passport, force majeure…), and your sponsor’s documents if any.
- Work with the immigration authority: the Immigration Office of the provincial/city Police where you reside, or the Immigration Department (Hanoi, Ho Chi Minh City). The authority will make a violation record and issue a penalty decision.
- Pay the fine as stated in the decision, using the method and at the place instructed, and keep the receipt.
- Complete the exit procedures: after you have complied with the penalty, the immigration authority will tell you which documents you need to leave Vietnam legally within the permitted time (or you will follow the deportation decision if one is applied).
- Book your ticket and depart within the permitted time, carrying the penalty decision, receipt and any documents issued to you.
Processing time varies by case and by locality; complex cases (very long overstays, lost passports, no sponsor) may take several working days.
Common long-overstay situations
- An expired temporary residence card that the company did not renew in time, or after you have left your job.
- A lost or expired passport, while waiting for your embassy to issue a new one. See the list of embassies and consulates in Vietnam.
- Illness or a long hospital stay that prevented you from leaving on time.
- Staying for family reasons (a Vietnamese spouse or child) without having obtained a family visit visa.
- Being scammed by someone who provided a fake visa or an improper extension.
If you have a Vietnamese spouse or child, or a sponsoring company, we can advise on applying for a new visa to return legally once the violation has been resolved, provided deportation has not been applied.

Frequently asked questions
What is the fine for overstaying a visa by 1 month?
An overstay of 30 days to under 60 days is fined VND 10,000,000–15,000,000; 16 days to under 30 days is fined VND 5,000,000–10,000,000.
Will I definitely be deported if I overstay by more than 15 days?
Not necessarily. Deportation is an additional penalty, considered based on the nature and severity of the violation and the circumstances of each case. Coming forward voluntarily, cooperating and having a legitimate reason all work in your favor.
I lost my passport and have overstayed. What should I do first?
Report the lost passport to the police where it was lost, contact your country’s embassy or consulate for a new passport or travel document, and only then work with the immigration authority to settle the fine and exit.
After paying the fine, can I stay in Vietnam?
It depends on your case. If you are not deported and have an eligible agency, organization or relative to sponsor you, a visa or extension of stay may be considered; otherwise, you must leave within the permitted time.
